Our Mediation Practice

In mediation, the parties work with a third party neutral (mediator) whose role is to bring about a mutually beneficial agreement. The mediator does not take testimony, consider evidence or make rulings of law or determinations of fact. Instead, the mediator encourages the parties to find common ground and helps them identify ways that they can come together in agreement. If the parties come to an agreement, it will be enforceable in a court of law. The agreements reached in mediation cannot, however, be appealed to any court.

At our offices, we work directly with individuals involved in lawsuits as well as attorneys who believe that their clients' cases can be more effectively resolved without the intervention of the courts or resort to discovery, depositions, interrogatories and trial. Attorney Engen is qualified to serve as a mediator.

Our Arbitration Practice

An arbitration is essentially a trial without a jury, but with a lawyer or panel of attorneys with specialized knowledge in the subject matter of the dispute. Unlike mediation, arbitration can include full discovery. Arbitrators will listen to testimony from witnesses and consider the relevance of evidence. Arbitrators also render a decision, which can be appealed to the district court.
